These terms and conditions were drawn up on June 1, 2020, and are valid until new terms are published.
MarinePlan is a company in the Netherlands with Chamber of Commerce number 70409811.
In these terms and conditions, products means: physical deliveries, digital deliveries, services, digital services, software, data, online access to digital products, or any other service provided to the user.
In these terms and conditions, user means: a person or organization that purchases products from MarinePlan and/or uses these products.
Conditions
- MarinePlan fully complies with the GDPR legislation.
- No information is shared with third parties, except as authorized by the user and indicated in the products.
- MarinePlan does not require accounts or passwords. In the case of data exchange at the user’s request, a flash connection will be used, in which very limited information (limited to what is immediately necessary for navigation) is shared via a secret key between, for example, the online route planner and the user’s app via a temporary, secure connection. After this, the information is immediately deleted.
- All digital links between products are guaranteed to be secure connections such as https.
- Personal data collected only with the user’s explicit consent (the legal basis for the processing) includes the boat name, position and time of the position, telephone number, arrival times, and the route to be sailed, including associated details such as departure point, destination, and times. This is similar to the data shared by other vessels via VHF (AIS).
- This data may be shared with local authorities solely to improve the passage of shipping traffic and the operation of bridges and locks.
- Privacy data shared with other app users is intended to improve the navigation experience and enjoyment.
- Privacy-sensitive data collected remains in circulation for a maximum of 24 hours, after which it is permanently deleted.
- Less privacy-sensitive data can be shared with third parties with the user’s explicit consent (the legal basis for the processing). This is to analyze the user experience and implement improvements (analytics, such as Google Analytics and MixPanel Analytics). The user has full control over this and can indicate in the products that this data should be deleted immediately and irreversibly.
- All products and data are stored and processed in the EU.
- There are no other data processors for the user’s data than those mentioned here.
- It is possible to explicitly enable or disable information sharing.
- It is possible to immediately delete all collected data.
- In the event of a dispute, the user can contact MarinePlan’s Data Protection Officer and/or file a complaint with the Dutch Data Protection Authority.
